Jet Verge LLC – Designated Agent For Service – Terms & Conditions

1. Introduction

Welcome to Jet Verge LLC ("Jet Verge," "we," "us," or "our"). We provide FAA-designated agent for service solutions to individuals and entities with non-U.S. addresses holding or applying for FAA certificates, ratings, or authorizations.

By using our platform and services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use our services.

2. Services Provided

Jet Verge acts as your FAA designated U.S. agent for service in accordance with FAA regulations (14 CFR Part 3, Sections 3.301 - 3.303). Our services include:

  • Providing a U.S. address for FAA service of documents.
  • Receiving and processing FAA correspondence on your behalf.
  • Scanning and electronically forwarding documents through your member dashboard.
  • Assisting with compliance by maintaining accurate records and forwarding notices.
  • Securely storing physical documents (for Pro Plan members) in a climate-controlled vault.

3. Eligibility

To use Jet Verge services, you must:

  • Be an FAA certificate holder or entity required by the FAA to designate a U.S. agent.
  • Provide accurate and current personal information.
  • Maintain an active account in good standing.

4. Client Responsibilities

By using our services, you agree to:

  • Keep your contact information current in your member dashboard.
  • Ensure your designated agent information is up to date with the FAA.
  • Promptly review and respond to forwarded FAA documents.
  • Pay all fees on time to maintain active service status.

Failure to meet these responsibilities may result in service suspension or termination.

5. Document Handling & Liability

Jet Verge is committed to timely and secure document processing.

  • Processing Time: FAA documents received by Jet Verge will be scanned and electronically forwarded within one (1) business day.
  • Physical Mail Forwarding: For members with shipping services, documents will be sent out promptly using the msot efficient delivery method.

Limitation of Liability:
Jet Verge is not responsible for:

  • Client inaction on forwarded FAA documents.
  • Unforeseen technical issues beyond our control.
  • Delays or losses caused by incorrect or outdated client information.
  • Legal consequences resulting from the client's failure to respond to FAA notices.

6. Fees & Payment

To activate and maintain services, you agree to the following payment terms:

  • Plan Fees: Membership fees are billed monthly according to the plan selected (Basic, Plus, or Pro).

  • No Refunds: Payments are non-refundable once the billing period begins.
  • Account Setup Fee: A one-time $10 setup fee applies at registration.
  • Automatic Renewal: All plans automatically renew monthly unless canceled by the client.

Failure to make timely payments may result in service suspension or cancellation.

7. Non-Payment Procedure

If payment is not received by the due date:

  • Suspension: Services will be suspended, and no further documents will be processed.
  • Grace Period: Jet Verge will hold any received documents for 30 days.
  • Permanent Deletion: If payment is not made within the grace period, all stored documents will be permanently deleted, and your U.S. agent designation will be revoked.
  • Reactivation: You may reactivate your account during the grace period by paying outstanding fees. After this period, a new registration will be required.

8. Shipping & Document Forwarding

For members with mail forwarding services, the following terms apply:

  • Electronic Forwarding: All FAA documents will be digitally scanned and uploaded to your member dashboard.
  • Physical Mail Forwarding:
       
    • Basic Plan: One-way document forwarding.
       
    • Plus & Pro Plans: Two-way document forwarding

  • All mailing and forwarding costs associated with FAA correspondence are included in the client’s selected membership plan.

  • Clients will not incur any additional shipping fees for the forwarding of FAA documents.

Jet Verge reserves the right to determine the most efficient and reliable delivery method to ensure timely and secure handling of all forwarded correspondence.

     

9. Account Deletion

If you request to delete your account:

  • All associated documents, certificates, and personal data will be immediately and permanently deleted.
  • Any remaining subscription period will not be refunded.

10. Termination & Suspension

Jet Verge reserves the right to terminate or suspend services under the following conditions:

  • The client provides false or misleading information.
  • Payments are not made on time.
  • The client fails to comply with FAA regulations.
  • The client engages in fraudulent or illegal activities.

11. Limitation of Liability

Jet Verge provides services on an "as is" and "as available" basis.

  • We make no guarantees regarding document delivery times or third-party service performance.
  • Jet Verge is not liable for indirect, incidental, or consequential damages, including but not limited to:
       
    • Missed FAA deadlines.
       
    • Loss of certification.
       
    • Delays caused by third-party services or mail carriers.
  • Our total liability, if any, is limited to the amount paid for the service in the preceding 12 months.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States.

  • Any disputes arising from these Terms will be resolved through arbitration in the state where Jet Verge LLC is registered, unless otherwise required by law.

13. Amendments

Jet Verge reserves the right to update or amend these Terms at any time.

  • Significant changes will be posted on our website with a revised effective date.
  • Your continued use of the service constitutes acceptance of the updated Terms.

14. FAA Communications & Compliance

By using Jet Verge as your U.S. agent for service, you authorize us to:

  • Receive official FAA notices on your behalf.
  • Forward FAA-related correspondence to your designated contact.
  • Retain and manage necessary records for compliance.

Failure to keep your U.S. agent designation current may result in FAA certification suspension. It is your responsibility to notify us of any changes to your contact information.
